How Khula Works in Pakistan
The Khula Process, Step by Step
Filing the Petition
The wife files a Khula suit in the Family Court with jurisdiction, supported by the Nikah Nama and relevant documents. Your advocate prepares the petition to avoid procedural delays.
Notice & Reconciliation
The court issues notice to the husband and attempts reconciliation, as required by law. If reconciliation fails, the matter proceeds.
Decree
Where reconciliation is not possible, the court grants the Khula decree. The wife may be required to return the Haq Mahr received, depending on the circumstances.
Union Council Confirmation
The decree is sent to the Union Council, which issues the effective divorce certificate after the statutory period. A typical Khula takes 3–6 months.
Family Law FAQ
Your Questions, Answered
How long does a Khula take in Karachi?+
A Khula typically takes 3 to 6 months from filing to the Union Council's confirmation, depending on whether the husband contests the petition and the Family Court's hearing schedule.
Do I have to return the Haq Mahr to get a Khula?+
In a Khula, the court may direct the wife to return the dower (Haq Mahr) she received, since she is seeking dissolution. The exact position depends on the facts of the case and what was agreed in the Nikah Nama.
Who gets custody of children after divorce in Pakistan?+
Custody (Hizanat) is decided on the welfare of the child. Mothers generally have custody of young children, while the father remains the natural guardian responsible for maintenance. The court considers the child's best interests, age, and circumstances.
Can a woman file for Khula without the husband's consent?+
Yes. A wife can file a Khula suit in the Family Court without her husband's consent. The court conducts reconciliation proceedings and, if these fail, can grant the Khula decree.
Can overseas Pakistanis handle a family case in Karachi remotely?+
Yes. Through a Special Power of Attorney you can authorise us to file and pursue your family matter in Karachi while you remain abroad. We handle court appearances and documentation, keeping you updated over WhatsApp and email.
How much maintenance can a wife or child claim?+
Maintenance is determined by the court based on the husband's or father's income and the reasonable needs of the wife and children. We help calculate a fair claim and pursue enforcement if payments are not made.
