Khula Procedure in Pakistan

Khula is the legal right of a Muslim woman in Pakistan to seek a court-ordered dissolution of her marriage when it has become unworkable — even without her husband's consent. It is recognised under Islamic law and governed by the Family Courts Act 1964.

At GNS Law Associates, we assist women in Karachi — and overseas Pakistanis — in filing and pursuing Khula cases with complete confidentiality and dedicated representation in the Family Court. Our experienced family lawyers guide you through every step with clarity and care.

Understanding Khula

Your Rights in a Khula

Right Without Consent

A wife can seek Khula on the ground that she cannot live with her husband within the limits prescribed by Allah. The court can grant it even if the husband does not agree.

Dower & Maintenance

Khula does not automatically cancel dower or maintenance. The outcome depends on the pleadings, facts, and the court's determination — which is why careful drafting matters.

Custody & Related Relief

Child custody and maintenance are separate reliefs that can be pursued alongside Khula. We handle these together so nothing is left unresolved.

Step by Step

The Khula Process in Karachi

1

Filing the Khula Suit

We file your Khula suit with complete annexures — the Nikah Nama, CNIC, and supporting documents. Clear, accurate drafting at this stage prevents service failures and procedural objections later, which matters given Karachi's heavy court cause lists.

2

Notice & Service to Husband

The court issues notices to the husband. Correct addresses and complete Nikah Nama pages are essential here — incomplete documentation directly weakens case momentum.

3

Reconciliation

The court promotes reconciliation between the parties, as required by law. If reconciliation is not possible, the matter proceeds to decree.

4

Decree & Union Council

The court grants the Khula decree dissolving the marriage. It is sent to the Union Council, which issues the divorce certificate after the statutory period.

Be Prepared

Documents You'll Typically Need

  • Nikah Nama (marriage certificate) — complete, all pages
  • CNIC of the wife (and husband's details if available)
  • Children's documents, if custody or maintenance is also sought
  • Correct residential address of the husband for service of notice
  • Any supporting evidence relevant to your case
