How Custody Is Decided
The Principle of Hizanat
Welfare of the child comes first. Pakistani courts decide custody on what serves the minor's welfare — not the automatic right of either parent. Financial stability, character, the home environment, and the child's needs are all weighed.
The mother's right (Hizanat). Mothers are generally granted custody of young children — commonly a son until around the age of seven and a daughter until puberty — unless it is shown that this does not serve the child's welfare.
The father as natural guardian (Willayat). The father remains the natural guardian, responsible for the child's maintenance and major decisions, and may be granted custody where it serves the child's welfare — for example where the mother is unable to provide proper care.
