Know Your Options
Talaq, Khula & Delegated Divorce
Talaq (by the Husband)
A Muslim husband may pronounce Talaq, but it only becomes legally effective once written notice is given to the Union Council and the reconciliation period is observed. We draft and serve the Talaq notice correctly to avoid it being challenged later.
Khula (by the Wife)
A wife can seek Khula through the Family Court when she cannot continue the marriage. The court can grant Khula even without the husband's consent if reconciliation fails — often requiring return of the Haq Mahr (dower).
Delegated Divorce (Talaq-e-Tafweez)
If the right of divorce was delegated to the wife in her Nikah Nama (clause 18), she may exercise it directly, following the same notice procedure as Talaq.

FAQ
Divorce — Common Questions
How long does a divorce take in Karachi?+
For Muslim couples, a Talaq generally takes around 90 days due to the mandatory Union Council reconciliation period. Court-based divorces such as Khula may take longer depending on whether they are contested.
Can a wife get Khula without the husband's consent?+
Yes. If the wife can show she cannot live with her husband within the limits prescribed by Allah, the Family Court can grant Khula without his approval if reconciliation fails.
Is it necessary to go to the Union Council for divorce?+
Yes. For Muslim couples, a divorce notice must be sent to the Union Council and reconciliation proceedings are required by law before the divorce becomes effective.
Can Christians and Hindus get legally divorced in Pakistan?+
Yes. Christians file under the Christian Divorce Act 1869, and Hindus may seek separation or annulment under the Sindh Hindu Marriage Act 2016.
What happens to child custody and maintenance?+
You can apply for child custody and maintenance through the Family Court. The child's welfare is the court's priority, and these matters can be pursued alongside the divorce.
Can I handle my divorce from abroad?+
Yes. Overseas Pakistanis can complete a Talaq or Khula in Karachi through a Power of Attorney, without travelling. See our dedicated overseas divorce service.
