Send or Reply to a Legal Notice

A legal notice is the first formal move in most disputes — the point where a demand becomes a matter of record. Whether you need to send one or you have received one, it is drafted, served, and defended by advocates who will also take the case to court if it gets there.

Why It Matters

The Notice Sets the Terms of the Dispute

A legal notice is a formal written demand, served by an advocate, that tells the other side exactly what is claimed, on what legal basis, and what happens if they do not comply. It is the document a court looks back on to see who acted in good faith and who did not.

Done properly, a notice often resolves the matter without litigation — many opponents settle once they see the claim is serious and the paperwork is in order. Done carelessly, a weak or wrongly-worded notice can damage your position before the case even begins.

At GNS Law Associates we draft notices as the opening step of a litigation strategy, not as a standalone letter. Every notice is written so that, if the other side ignores it, the suit that follows is already halfway built.

Know Before You File

When a Notice Is Required by Law

In some matters a notice is simply good strategy. In others, the law will not let you file suit until you have served one — and getting the notice period or wording wrong can cost you the case at the threshold.

Suing the Government or a Public Officer

You must serve a written notice and wait two months before instituting the suit. Skip it, and the plaint is liable to be rejected.

Section 80, Code of Civil Procedure 1908

Defamation Claims

The aggrieved person is expected to serve a preliminary notice on the defendant before proceeding — a step opponents often use to challenge premature suits.

Defamation Ordinance 2002

Dishonoured Cheques

While a notice is not always a strict statutory bar, a properly served demand strengthens both the 489-F PPC complaint and the civil recovery that runs alongside it.

Section 489-F, Pakistan Penal Code

Contractual & Tenancy Matters

Many agreements and tenancies require notice — and a fixed cure period — before you can terminate, evict, or sue. We check the clause before serving.

How It Works

From Instruction to Served Notice

A clear, four-step process — most notices are drafted and dispatched within a few working days of receiving your documents.

01

Consultation

You share the facts and documents — free of charge, on WhatsApp, email, or at our Clifton office. We identify the claim and the right legal basis.

02

Drafting

We draft the notice on firm letterhead, setting out the facts, the law, the demand, and a clear deadline for compliance — reviewed with you before it goes out.

03

Service

The notice is served through registered post, courier, or approved electronic means, with proof of dispatch retained as evidence for any later proceedings.

04

Next Steps

If they comply or settle, the matter ends. If they ignore or reject it, we move straight to filing suit — with the notice already forming part of your record.

Common Questions

Legal Notice FAQs

How much does it cost to send a legal notice in Karachi?

Fees depend on the type of matter and complexity, but a legal notice is a fixed, one-time charge agreed in writing before we begin. The initial consultation is free and carries no obligation. Contact us on WhatsApp with the basic facts and we'll quote you a clear figure.

How long does it take to draft and serve a notice?

Most notices are drafted within a few working days of receiving your documents, then served by registered post or courier. Where a legal deadline is running — such as a defamation or contractual cure period — we can act on an urgent basis.

Is a legal notice legally binding?

A legal notice is not itself a court order, so it does not force the other side to act. What it does is create a formal, dated record of your demand and their response (or silence) — which becomes important evidence if the matter later goes to court, and often prompts a settlement before it does.

I have received a legal notice — do I have to reply?

You are not always legally obliged to reply, but ignoring a notice is usually a mistake. A well-drafted reply within the stated deadline protects your position and prevents the other side from claiming you had no defence. Send us the notice and we'll advise you the same day where possible.

Can I send a legal notice from abroad?

Yes. Overseas Pakistanis regularly instruct us to send notices in Karachi through a Special Power of Attorney, without travelling. We handle drafting, service, and any follow-up, and keep you updated over WhatsApp and email.

Do I need a notice before filing a case?

It depends on the matter. Some suits — for example against the Government or a public officer under Section 80 CPC — require a notice by law before you can file. In many other disputes a notice is not compulsory but is strongly advisable, both to attempt settlement and to strengthen your eventual case. We'll tell you which applies to yours.
