What is the difference between an appeal and a revision?
An appeal is a full re-hearing of the conviction and sentence on facts and law before the higher court, available as of right in most convictions. A revision is a narrower remedy — the High Court examines an order for material illegality, impropriety, or jurisdictional error, usually where no appeal lies. We advise which fits your case.
What is suspension of sentence?
After a conviction, a suspension of sentence application asks the appellate court to suspend the sentence and release the convict on bail while the appeal is pending — so the person is not in jail during what can be a lengthy appeal. It is usually filed alongside the appeal.
Can I get bail after conviction while my appeal is pending?
Yes — through a suspension of sentence application. If the appellate court suspends the sentence, you can be released on bail while the appeal is heard. We move for it as soon as the appeal is filed.
How long do I have to file a criminal appeal?
